If you do not agree, please do not use our website or engage our services. These terms apply to all visitors to our website and all customers who enter into a service agreement with us.
Santa Monica Asphalt Paving provides asphalt paving, sealcoating, asphalt repair, parking lot striping, driveway paving, concrete work, and related contractor services to residential and commercial property owners in Santa Monica, CA and surrounding communities. All services are performed by or under the supervision of licensed contractors. The specific scope of work for any project is defined in the written estimate or contract provided to the customer before work begins.
All estimates provided by Santa Monica Asphalt Paving are based on an in-person assessment of the work area and are provided in writing. An estimate is not a guaranteed fixed price until a written contract or work order is signed by both parties.
The final price may vary from the estimate if: (a) the actual scope of work differs materially from what was assessed during the estimate visit; (b) unforeseen conditions are discovered once work begins, such as base damage beneath the surface; or (c) the customer requests changes to the scope of work after the estimate is issued. Any changes to the agreed scope will be discussed with the customer before additional work proceeds.
Appointments are scheduled based on crew availability and weather conditions. Paving and sealcoating work requires dry conditions and appropriate temperatures. Santa Monica Asphalt Paving reserves the right to reschedule work if weather conditions make it unsafe or likely to result in a substandard job. We will notify you as promptly as possible if a reschedule is necessary.
If you need to cancel or reschedule a scheduled appointment, please contact us at least 24 hours in advance. Cancellations made with less than 24 hours notice may result in a rescheduling fee if materials were ordered specifically for your project. Any deposit paid is non-refundable if work is cancelled after materials have been purchased.
Payment terms are specified in the written contract or work order for each project. Standard terms are as follows unless otherwise agreed in writing:
Late payments may be subject to interest at the maximum rate permitted under California law. If collection action is required to recover unpaid balances, the customer may be responsible for reasonable collection costs and attorney fees.
Santa Monica Asphalt Paving stands behind its work. Any warranty for workmanship or materials will be stated explicitly in the written contract for your project.
Warranties do not cover: (a) damage caused by factors outside our control, including ground movement, seismic activity, root intrusion, heavy vehicle loads beyond the designed capacity, or extreme weather events; (b) normal wear and tear over time; (c) damage caused by the customer or third parties after project completion; or (d) conditions that existed prior to our work and were not disclosed or discovered during the estimate.
The website and any information on it are provided "as is" without warranties of any kind, express or implied. We make no warranty that the website will be uninterrupted or error-free.
To the fullest extent permitted by applicable law, Santa Monica Asphalt Paving and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or this website, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from services provided shall not exceed the amount paid by the customer for the specific project giving rise to the claim.

You agree not to use the site to submit false or misleading information, attempt to access systems you are not authorized to access, or engage in any conduct that could damage, overburden, or impair the site. We reserve the right to block access to the site for users who violate these terms.
If a dispute arises between you and Santa Monica Asphalt Paving, we encourage you to contact us first to try to resolve it informally. Most issues can be resolved quickly through direct communication.
If informal resolution is not possible, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association in Los Angeles County, California, unless both parties agree otherwise in writing. Each party shall bear its own costs in arbitration unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking emergency injunctive relief from a court to prevent irreparable harm.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration under Section 10 shall be brought in the appropriate state or federal courts located in Los Angeles County, California.
Santa Monica Asphalt Paving reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the website or our services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
